Depending on the amount of alcohol consumed, it can take a while to leave your system. It is not uncommon for people to face DUI charges the morning after a night out. The individual may believe that they are fine after getting some sleep. They might even feel perfectly fine. 

Nevertheless, what matters is the individual’s BAC reading. It’s possible that this could still read over 0.08% even on the morning after.
